Finland's permit agency questions Google's operator over 300 hectares of felled forest

Finland's permit agency has asked Tuike Finland, Google's local data center company, to explain clearing about 300 hectares of forest near Muhos. A conservation group wants the site halted until regulators decide whether the work was legal.

What happened

  • According to AFP, the trees were felled before a mandatory environmental impact assessment, with excavators clearing ground ahead of government approval.
  • Muhos is one of three northern sites, with Kajaani and Vaala, that Google wants to add to the facility it already runs at Hamina in southern Finland.
  • Tom's Hardware has seen no reports that preparation or construction work at the Muhos site has stopped.

Why it matters

  • Who's exposed exposure A pause at Muhos would land inside a two-year, 13 billion euro program, about 6.5 billion euros of planned spending a year, and the two-year window keeps running through any suspension.
  • Who has to decide decision Operators building in Finland have to choose whether ground clearing waits for the full project's environmental assessment or goes ahead under forestry rules and invites a review like this one.
  • What it sets up precedent Microsoft and TikTok, which also chose Finland, now have a live case of the permit agency asking an operator to account for clearing done before an assessment.

Google's defense and the complaint against it rest on different laws. Google told AFP that the felling was "in compliance with Forestry Act requirements" [15]. TechSpot describes the review that had not finished as an environmental assessment of the full plan [4]. Those are two separate questions. A felling can meet forestry rules and still have happened before the project it served was assessed. The reports do not say whether Finnish law allows clearing for a data center under forestry rules while the project assessment is still open.

The factual dispute is narrower, and easier to test. Google said the site was surveyed before the bulldozers moved in, so that high-value environmental areas would not be damaged [17]. Its communications manager in Finland told AFP that "high-value nature zones within the sites have been protected during forestry works" [16]. Hanna Halmeenpaa, who chairs the Finnish Association for Nature Conservation, says satellite imagery shows that areas that should have been protected have been leveled [7]. Three square kilometres of bare ground [12] is easy to find from orbit. Google's survey boundaries laid over that imagery would show which account is right.

Halmeenpaa also wants the work stopped. "In our view, operations at this construction site should be suspended until it is clarified whether the project is in compliance with the law," she told AFP at the edge of the cleared area near Muhos [6]. Muhos has fewer than 9,000 residents [14]. Its mayor welcomes the investment. Residents have raised concerns about the environment, energy supply stability and energy prices [18].

Finland's pitch to builders holds up on the engineering side. It has a cool climate and stable, cheap energy that is mostly nuclear, wind and hydro. Its government sees data centers as a remedy for slow growth and record-high unemployment [9]. None of that changes the order in which approvals arrive. I think the schedule risk at Muhos comes from that order.

The agency put its questions to Tuike Finland Oy last month, according to TechSpot [1]. So far the risk is an inquiry and a request for a halt. The evidence does not yet show a delay. If the agency decides the clearing was part of the project, then the early ground work is what it reviews, and any halt would fall on a site that is already cleared.

What to watch

  • Whether the LVV orders work at Muhos suspended or accepts Tuike Finland's explanation.
  • Whether the full-plan environmental assessment finds that protected areas inside the Muhos site were cut, as the satellite imagery Halmeenpaa cites suggests.
  • Whether site preparation at Kajaani and Vaala follows the same order, with clearing ahead of assessment.
